Another Important Update to Utah Online Regulation

UPDATE (2/16/24): Utah's follow up letter is available for download here, which provides additional information about the recent rule change.

Effective February 2, 2024, Utah has issued an emergency rule change pertaining to regulations governing online sales (R70-101) that were implemented on January 1, 2024.  

Regulations Paused for Bedding & Furniture

This repeal pauses the enforcement of the online regulation of bedding and furniture law labels. Several sources have indicated that this does not signify the permanent end of regulatory oversight in online sales within Utah. Rather, this is a temporary cessation while the state plans to undertake a comprehensive review and rewrite of the regulations to better align with the industry. 

From what we understand, this emergency rule change provides a brief period for review and further action. If in 120 days (about 4 months) and no amendments have been made, the original requirement will go back into effect. For this reason, we assume all parties involved will be motivated to finalize a new requirement. 

Regulations Remain for Quilted Clothing

Utah has also indicated that their rule change is specific to bedding and upholstered products. Their requirements for the online sale of quilted clothing (i.e., textiles) remain intact. Whether they will enforce these requirements for quilted clothing during the emergency rule change is to be determined. 

We recognize this might be confusing due to the term “online” being struck through their emergency rule change. However, the Utah office indicated their overarching code does not differentiate between brick-and-mortar and online sales, allowing for this exception to the emergency rule change.
